Everyone should have a will prepared. A will is a written document that provides direction for the settlement of your probate estate. Your probate estate consists of assets that do not pass directly to survivors or beneficiaries such as insurance policies, trusts, joint property, and accounts or investments with designated beneficiaries. Your will can also set forth provisions, through the use of a trust, for effective management of assets for the benefit of beneficiaries such as minor children. Another very important issue addressed in your will if you have children is to nominate the guardians for your children.

Health Care Proxies

A health care proxy permits you to appoint someone you trust to make decisions regarding your medical treatment in the event that you lose the ability to make the decisions yourself. Everyone should have an up to date health care proxy in case of an unexpected hospitalization, emergency or injury.

Powers of Attorney

Powers of attorney allow you to direct who will be responsible for managing your assets and other financial affairs in the event you become incapacitated. With a power of attorney in place, your family will not have to engage in the costly and stressful process of involving the court in these decisions.
